The Employee Retirement Income Security Act (ERISA) specifies that all plans, regardless of the number of participants, establish and maintain a written document containing specific provisions. These documents must include key provisions such as the following:

  • Naming one or more plan fiduciaries with authority to control and manage the administration of the plan.
  • Describing a procedure for establishing and carrying out a funding policy.
  • Describing plan procedures for distributing plan operation and administrative responsibilities.
  • Describing a procedure for and identifying who can make plan amendments.
  • Describing the basis on which payments are made to and from the plan.

A Plan Document is required for every Welfare Benefit Plan that an employer maintains that is subject to ERISA regulations.
